A Hammond man got two years probation Friday after shooting a relative in the leg.

Carl Butler, 49, pleaded guilty to battery resulting in serious bodily injury.

The victim told police he had been at Butler’s birthday party the prior night when he lost his phone.

Everyone was drunk or high and a “very chaotic” argument broke out with “everyone shouting different things.”

Someone hit Butler, who had a swollen face. The victim and his two friends left the party around 11 p.m. The trio returned to Butler’s home on the 900 block of Becker Street the next morning around 7 a.m. The victim saw his cellphone on the ground.

Butler’s brother came out and accused the victim of hitting Butler.

Butler came out and asked the man where his birthday present was. The victim went back to his car and got a glass of vodka for him, according to the affidavit.

Butler then pulled out a gun and shot the victim in the right leg and went back inside, court records show. The victim went to the hospital for treatment and was walking with a cane afterward.

Butler’s lawyer Thomas Olson said after Friday’s hearing that his client had a “minimal” criminal history, the victim didn’t have a life-threatening wound and Butler stayed out of trouble through his sentencing.
