A bench of Justice Jyoti Singh also issued notice to the Election Commission of India, Delhi Police and the returning officer of Kalkaji assembly constituency, from where Atishi won the election.

The constituency voters, Ayush Rana and Kamaljit Singh Duggal, filed a challenge to Atishi’s election, alleging that she and her election agents engaged in corrupt activities throughout the voting process. The petition, filed through advocate T Singhdev, sought to declare the election null and void.

The returning officer and the Election Commission of India’s attorney objected to being named as parties in the petition during the hearing. The court has listed the matter for further hearing on July 30.

Atishi won from the Kalkaji seat defeating her BJP rival Ramesh Bidhuri by 3,521 votes. Voting for the Delhi Assembly Election was held on February 5 and the results were declared on February 8. While BJP won 48 seats in 70-member Assembly, AAP was reduced to 22. Prominent AAP leaders, including former Delhi CM Arvind Kejriwal, ex-deputy CM Manish Sisodia and others were unable win from their respective constituency.

Atishi on Delhi Budget

Meanwhile, LoP Atishi has written to Speaker Vijender Gupta requesting that the next two days should be devoted solely to the discussion on the Budget.

She said, “The budget session is to present budget and hold a discussion on budget but yesterday, when the list of business for today came, only one hour was allotted for discussion on budget…I want to ask BJP, what are you hiding? Why don’t you want a discussion on budget?…This clearly shows there is something wrong. I have written to Speaker Vijender Gupta and demanded at least two days for discussions on budget…”
